This is an amendment to the governing documents for Shipwatch Village, a single-family home community in Wilmington, NC. It modifies the original declaration to establish an Architectural Control Committee, define the Shipwatch Village Homeowners Association's powers, and clarify the jurisdiction of the Shipwatch Association and a separate Dock Association. - Architectural review: The Shipwatch Village Association appoints an Architectural Control Committee to review and approve all proposed buildings and improvements for conformity and harmony of external design.
- Homeowners Association & assessments: Every lot owner automatically becomes a member of the Shipwatch Village Homeowners Association. The Association can levy annual assessments (increased up to 10% per year without membership vote, or without limit by a 2/3 vote) and special assessments for capital improvements (approved by 2/3 vote). Assessments are a personal obligation and a lien on the lot.
- Dock Association & limited common facilities: A separate Dock Association has jurisdiction over Limited Common Facilities and Boat Slips, including the power to enforce restrictions and levy assessments. The Shipwatch Association has no authority over these areas.
- Enforcement & fines: The Dock Association may impose fines and other sanctions against lot owners for failing to comply with its rules or the declaration regarding matters under its authority. Failure to comply can result in legal action for damages or injunctive relief.
- Occupants bound: All provisions of the declaration and the rules of both associations apply to occupants of any lot, not just owners.
