Summit Center is a condominium community in Wilmington, NC — you own your individual unit and share ownership of the building's common elements. The association maintains the exterior and common areas, and the property is restricted to office use only. This document is the full declaration and bylaws, binding all unit owners.
- What you own & maintain: You own your unit's interior in fee simple. The association maintains the common elements and provides exterior maintenance for each unit, including roofs, exterior surfaces, trees, shrubs, walks, and exterior glass. If damage is caused by your negligence, you pay the cost.
- Use restrictions: Units may only be used for office purposes. No noxious or offensive activities are allowed. No animals, livestock, or poultry are permitted except seeing-eye dogs (not for commercial purposes). No outside antennas or satellite dishes without board approval. Signs require board approval. Window coverings must be off-white two-inch mini blinds.
- Parking & vehicles: Each owner has a limited common element right to use parking spaces in the common parking area. No campers, trailers, or similar vehicles may be parked or stored on the premises. Only standard 2-ton pickup trucks or smaller trucks are allowed.
- Leasing & rentals: Owners may delegate their right to use common elements to tenants. No minimum lease term is stated in this document, but the declaration does not restrict leasing beyond the office-use requirement.
- Assessments & fees: Annual and special assessments are levied per unit based on each unit's percentage of ownership (see Exhibit B). The maximum annual assessment can increase up to 5% per year without a membership vote; higher increases require a two-thirds vote. Unpaid assessments become a lien and accrue interest up to 18% per year.
- Architectural review: No building, fence, wall, or other exterior improvement or change may be made without prior written approval of plans. The exterior color of a unit cannot be changed unless the entire condominium's color scheme is similarly changed, requiring two-thirds owner approval.
- Insurance: The association carries master fire, casualty, liability, and flood insurance. Each owner must maintain their own liability insurance with at least $1,000,000 per person and per occurrence, naming the association as an additional insured. Owners waive subrogation against each other.
- Party walls: Walls and flooring connecting adjacent units are party walls. The cost of repair and maintenance is shared by the owners who use the wall in proportion to use. Negligent or willful acts causing exposure to the elements are the sole responsibility of the at-fault owner.
