Indian Pointe is a standard single-family home subdivision in Omaha, NE, governed by a homeowners association (HOA). If you own a lot here, you must comply with detailed architectural, land-use, and behavioral rules designed to protect the neighborhood's quality and value.
- Lot & home standards: Only one detached single-family home per lot, with minimum square footage: 1,600 finished square feet on the main floor for ranch homes, 2,000 for two-story homes (exclusive of garages, basements, patios). Front of the house must be at least 1/3 masonry, brick, or stone. No tree houses, tool sheds, or windmills are allowed.
- Architectural review: Before building, altering, or adding any exterior improvement (including fences, patios, decks, swimming pools, and trees/shrubs), you must submit plans to the Declarant or a Plan Reviewer. Approval is based on harmony with the community, and if you don't get a written approval within 30 days, the proposal is considered disapproved. The Declarant has the right to approve or reject colors, materials, and design.
- Fencing & landscaping: Fences must be wood cedar (board-on-board scalloped design, 6 ft high), decorative black rod iron, or powder-coated aluminum (6 ft). No chain link or wire fences. All yards must be sodded, and at least one tree with a 2.5-inch diameter must be planted in the front yard. No hedges or mass shrubs are allowed more than 10 ft in front of the front building line without approval.
- Pets: Only household pets are allowed, to the number permitted by Omaha city ordinances. No breeding or commercial keeping. Pets must be confined to the lot by a fence or leashed when outside. The owner must clean up after the pet. Dog runs are prohibited.
- Vehicles & parking: No boat, camper, trailer, mobile home, truck, aircraft, or camper truck may be stored on a lot outside an enclosed structure for more than 20 days per year. No major vehicle repairs (over 48 hours) on lots. No grading or excavating equipment or semi-tractors/trailers may be parked. Each lot must provide off-street parking as required by Omaha ordinances.
- Assessments & dues: All owners of improved lots pay monthly assessments for common area maintenance and operations. A special capital improvement assessment requires a two-thirds vote of each membership class. Assessments become a lien if unpaid. Maximum monthly dues (including any Indian Pointe Club dues) could not exceed $100/month through January 1, 2018, and after that may not exceed 125% of the prior year's aggregate.
- Indian Pointe Club (optional): The Declarant may build a recreational clubhouse with tennis courts, pool, and fitness facility. If built, owners of improved lots must pay monthly club dues (initially $55) as part of HOA assessments, and the club can increase dues to $100/month without owner consent. Use is limited to community recreation for owners, families, and guests. The Declarant has no legal obligation to build the club.
- Amendment & term: The covenants run with the land for 20 years from December 2013, then automatically renew for successive 10-year periods unless terminated or amended by 75% of lot owners. However, for the first 20 years, the Declarant has the sole right to amend the declaration without owner approval.
