- What this document covers: This is a collection of board regulations (numbered Zero through Five) that supplement the Association's CC&Rs. It does not contain the full CC&Rs, but focuses on enforcement, fines, common area use, parking, yard maintenance, and collection processes.
- Fines for violations: Minimum fine for most violations is $200, which may be increased up to 100% of repair cost. Vehicle parking violations are $100 per day after notice. Reckless driving: $200 per offense. The Board can deviate from these amounts on a case-by-case basis after a hearing.
- Common areas & access: Prior authorization is required before placing vehicles, construction equipment, or landscaping materials on common areas. Damage to common areas must be repaired at the homeowner's expense.
- Parking restrictions: Vehicles may be parked in designated parking areas for no more than 3 consecutive days without moving (removal from the community). Parking may be temporarily prohibited with 24-hour notice. No motorized land-use vehicles (e.g., RVs) on non-street common areas.
- Yard maintenance & landscaping: Owners must maintain front and side yards free of weeds and dead vegetation. Trees, shrubs, and bushes must be trimmed and present a neat appearance. Palm trees must be trimmed annually. A prohibited plant list is included (e.g., Buffelgrass, Desertbroom).
- Golf cart path & pedestrian access: The Association holds easements and licenses for a golf cart and pedestrian path to Esperanza Boulevard. Use is at the member's own risk; the Association must maintain liability insurance of at least $1,000,000 per occurrence/$2,000,000 aggregate. The path may be temporarily blocked for maintenance.
- Assessment collection process: Delinquent assessments trigger: 30-day friendly reminder with 10% late fee, 60-day delinquent notice, 90-day demand letter with 10-day intent-to-lien notice, then referral to counsel. Fines are due within 30 days of notice; daily fines accrue every 30 days.
- Violation reporting & hearing procedure: Violations must be reported in writing to the managing agent or appropriate committee, including description, date/time, and violator identification. Owners must inform tenants of rules in writing. Hearings are held before the Board before fines are imposed.
