The Magnolias at Southridge is a planned community (PUD) of attached townhomes/condominiums in Simpsonville, SC. You own your individual unit and lot, and the homeowners association maintains the common areas and provides exterior maintenance for the buildings. These rules bind all owners, their tenants, and guests.
- What you own & maintain: You own the interior of your townhouse unit and the land it sits on (your Lot). The Association handles exterior maintenance including roofs, gutters, painting/staining, and common area upkeep. You are responsible for windows, screens, doors, hinges, locks, and any damage caused by your negligence.
- Leasing & rentals: No dwelling may be leased for hotel or transient purposes. All leases must be in writing, for a term of at least six months, and you must lease the entire dwelling (no partial unit rentals). A copy of each lease must be filed with the Association. All lessors and lessees are subject to the Declaration and rules.
- Pets: You may keep up to one dog (maximum 20 pounds unless a trained service animal for the blind or disabled) and up to two cats. No exotic pets (alligators, snakes, wild animals) are allowed. Pets must always be leashed when outside the townhouse. Owners must immediately clean up and dispose of pet waste. Fines escalate: $10–$20 for first offense, $25–$50 for second, and third offense can result in removal of the animal.
- Assessments & fees: Annual assessments are levied per Lot, paid monthly. The initial maximum annual assessment was $900 per Lot (as of 1999) and can increase up to 5% each year without a membership vote. A working capital fund (equal to at least two months' assessments) is paid at closing. Special assessments for capital improvements require a 2/3 vote of members. Unpaid assessments accrue 6% interest and can result in a lien and foreclosure.
- Architectural review & exterior changes: No building, fence, sign, wall, or other structure may be built or altered, and no trees or shrubs may be planted, without prior written approval from the Board or its architectural committee. Plans must be submitted; if not approved or disapproved within 30 days, approval is deemed granted. Exterior additions or changes that impair structural integrity or alter the exterior are prohibited without authorization.
- Parking & vehicles: Each Lot is entitled to two parking spaces, assigned by the Association. No motorcycles, trucks, boats, or trailers are allowed in common areas (including the parking lot and roads). No vehicle maintenance or repairs may be performed in common areas. Vehicles must display current license tags and may not be stored in common areas.
- Use restrictions & quiet enjoyment: All Lots are for residential use only. No business, trade, or profession is permitted. No obnoxious or offensive activity, nor anything that becomes a nuisance, is allowed. The property is a bird sanctuary — hunting birds is prohibited. Speed limits may be set by the Board.
- Other rules & enforcement: Signs (except Declarant's 'For Sale'/'For Rent' signs on unsold units) are prohibited. No alterations to common areas without written consent. The Board can adopt rules, impose fines, suspend voting and common-area use rights for up to 60 days for infractions, and suspend them during assessment nonpayment. Tenants and guests must comply with all rules; owners are responsible for their compliance.
