What Sincuidados HOA's governing documents say
Sincuidados is a single-family homeowner community in Arizona (Maricopa County) with gated access and strict rules to preserve natural desert open space. Property owners pay assessments and must comply with detailed rules covering parking, leasing, modifications, and community use.
- Leasing & rentals: Leases must be in writing for a minimum of one year covering the entire lot to a single family; the lessee must receive a copy of the rules and guidelines. The owner is fully responsible for ensuring lessee compliance and is jointly liable for any violations.
- Assessments & payment: Assessments are levied per lot. If unpaid within 30 days of the due date, a late charge equal to the greater of $15 or 10% of the amount is added. After 75 days, the Association records a lien and may pursue foreclosure or personal judgment; the lien remains against the property even if ownership changes.
- Non-payment & suspension of rights: Owners 30 or more days behind lose access to the clubhouse, voting rights, and transponder/gate access until the full account is paid, including all late fees and collection costs. Access to private roads necessary to reach your lot cannot be suspended.
- Violations & enforcement: Violations incur fines under the Violation Policy; owners may appeal within the deadline by demonstrating extenuating circumstances. A third violation notice can result in suspension of clubhouse and voting rights for up to 60 days (single infraction) or one year (repeated violations).
- Natural area preservation (NAOS): All property outside each lot's building envelope is Natural Area Open Space, strictly regulated by Scottsdale city ordinance. You may remove dead vegetation and invasive plants (mistletoe, desert broom) within specified distances of structures, but cannot add permanent structures, lighting, irrigation, or non-native plants without City and Design Review approval.
- Parking & vehicle rules: All resident vehicles must be parked in fully enclosed garages; driveway and street parking are discouraged and subject to citation. Non-residents must register at the Pima gate; temporary permits allow up to 14 days; no overnight street parking between midnight and 5 AM is permitted.
- Clubhouse & recreational courts: The clubhouse can be reserved for private non-commercial events with a refundable deposit; all assessments must be current and cleanup must be completed by 9 AM the day after your event. Tennis and pickleball courts can be reserved up to one week in advance for a maximum of two hours; only these two sports are permitted.
- Design & exterior modifications: Most exterior changes require Design Review Committee approval, including antennas, landscaping, and architectural alterations. Real estate signs (max 18"×24" plus one rider) are permitted but must be removed immediately after sale closing and cannot be placed in NAOS or common areas. Holiday displays are allowed temporarily within 30 feet of the building.
