This is a Lot Improvement and Approved Builder Agreement for The Refuge Community Association, Inc. in Lake Havasu, Arizona. It is a contract between the association, a lot owner, and an approved builder, not the community's full governing documents. It sets rules and deposits for constructing improvements on a specific lot, but does not cover general community restrictions like leasing, pets, or assessments.
- Approved Builder Requirements: Only builders approved by the association may construct homes. Builders must provide proof of licensing, insurance, and experience, and comply with all project documents (Declaration, Design Guidelines, Construction Rules).
- Deposits & Fees: The builder must pay a $10,000 security deposit. The owner must pay deposits: Building Compliance $6,500 ($1,000 nonrefundable), Landscape $2,300 ($300 nonrefundable), Walls/Fences $2,500 ($300 nonrefundable), Pool $2,500 ($300 nonrefundable). Deposits are due before construction start.
- Insurance & Indemnification: The builder must carry liability insurance of at least $1,000,000, naming the association as an additional insured. The owner and builder agree to indemnify the association against claims arising from construction.
- Design Review & Compliance: All improvements must be approved in advance by the Design Review Committee. Construction must comply with the Declaration, Design Guidelines, and all applicable laws. Violations may result in fines or use of deposits to correct issues.
- Construction Conduct: The lot must be kept neat, dust-free, and safe. The builder cannot use adjacent lots without a written agreement. Must provide a trash can and Port-a-Potty. Failure to cure violations within 5 business days allows the association to enter and remedy at builder's cost.
- Default & Termination: Events of default include failure to maintain insurance, deposits, or comply with rules. The association may terminate the agreement, but the builder may complete homes started before termination.
- What this document doesn't cover: This agreement does not cover general community rules such as leasing restrictions, pet limits, parking rules, or assessment amounts. Those are found in the Declaration and other association documents.
