This document is a 1987 revision of the restrictive covenants for the Valleybrook/Windbrook Subdivision in Chattanooga, TN, a standard single-family homeowner association (HOA). It binds all current and future owners of lots in the subdivision, and the rules run with the land. The document focuses on use restrictions, construction standards, and maintenance obligations for single-family residential lots.
- Property use (residential only): All lots are for single-family residential use only. No structures other than one single-family dwelling (max two stories) with an attached two-car carport/garage. No multiple-family dwellings, no commercial or business uses, and no temporary structures (trailers, tents, shacks) may be used as residences.
- Construction & minimum size: Each dwelling must have at least 2,100 square feet of enclosed main living area (excluding open porches, servants' quarters, carports, garages). For a two-story house, at least 1,200 square feet must be on the ground floor. All exposed masonry must be brick or natural stone; asbestos siding and permastone are prohibited.
- Setbacks & location: No residence may be nearer than 40 feet to the front or side street line, 12 feet to any side lot line, or 25 feet to the rear lot line. Lots adjoining golf course fairways must be 'two-front' houses.
- Architectural review: Plans, specifications, and a plot plan for any new construction or alteration must be submitted to a committee appointed by the Valleybrook/Windbrook Corporation for written approval, which shall not be unreasonably withheld. Approved plans remain on file.
- Vehicles & parking: No boats, trailers, campers, or motor homes may be parked on streets or any lot for more than 14 days. Driveway curb cuts require written approval from the Corporation.
- Animals: No horses, mules, burros, cattle, or similar livestock are allowed. Also no sheep, goats, swine, fowls, rabbits, or animals not ordinarily associated with residential uses.
- Maintenance & nuisances: Owners must keep their lot in a neat and orderly condition (grass cut, debris removed). If an owner fails to do so, the Corporation may enter, perform the work, and bill the owner. No rubbish dumping; garbage must be kept in sanitary containers.
