Cedardale is a residential subdivision in Knoxville, Tennessee governed by a Declaration of Restrictions that runs with the land and binds all lot owners. The declaration establishes the neighborhood as a single-family home community with specific construction and use standards, and it gives the developer broad control over approvals and modifications. This document is the original set of covenants recorded in 1993 and likely represents only part of the full governing framework, as it references a developer and permitting period that may have since expired or been superseded.
- Land use & building type: Lots are for one detached single-family dwelling no more than two stories, plus an attached garage. No metal or other storage sheds, no carports (unless developer grants written permission), and carports cannot replace a garage. Foundations must be bricked, roofs must have an 8/12 pitch minimum, and all windows must be wood only.
- Minimum dwelling size: Houses with 1½ or 2 stories must have at least 1,000 sq ft on the ground floor and a total of at least 2,200 sq ft across both floors. One-story houses (or one story plus a basement) must have at least 1,600 sq ft on the uppermost level. Multi-level houses are considered case‑by‑case by the developer. Square footage excludes porches and garages.
- Architectural & design review: Building plans and a location survey must be submitted to the developer (or its successor) for written approval on quality, materials, design harmony, and siting. The developer has 25 days to approve or disapprove; failure to respond within 25 days counts as approval. Once construction is complete and no lawsuit has been filed, approval is deemed fully granted.
- Setbacks & location: Buildings must be at least 20 feet from the front lot line (unless a hardship exception is granted), 5 feet from side boundaries, and 15 feet from the rear boundary. Roofed porches count as part of the building and must be at least 8 feet from any lot line or the front setback line.
- Division of lots: No lot may be further subdivided or reduced in size, except to increase the size of another lot. One single‑family dwelling per lot, occupied by no more than one family. The developer may use any lot for road access to adjoining land.
- Fences & walls: Fences or walls require prior written approval from the developer. Chain‑link fencing is not permitted. Unapproved fencing may be removed by the developer without a court order.
- Vehicles, storage & nuisances: No inoperable or stored vehicles may be parked or repaired on streets, driveways, or lawns. Campers, boats, trailers, and similar items must be stored inside a garage invisible from the street. Drying clothes or other items visible from outside is prohibited. No noxious or offensive activities, dumping, or accumulation of trash or hazardous materials allowed.
- Pets: No livestock, poultry, or fowl may be kept. Household pets like dogs and cats are allowed, but not for commercial breeding or in such numbers as to create a nuisance or sanitation problem.
