What Chapel Creek Farms Homeowners Association, Inc.'s governing documents say
This is a set of six policy guidelines adopted by the Chapel Creek Farms Homeowners Association, a standard single-family HOA in Allen, TX. These rules supplement the main Declaration and cover religious displays, security measures, pool enclosures, architectural review, violation hearings, and bidding for large contracts. They apply to all homeowners in the community.
- Religious displays: You may display religious items on your property, but they cannot threaten public health or safety, violate other laws, be patently offensive for non-religious reasons, be placed on common or association-owned property, violate setbacks or easements, or be attached to traffic devices, street lamps, fire hydrants, or utility fixtures.
- Security measures: You can install security cameras only on your own property, not on common areas or elsewhere. Any perimeter fencing must comply with the HOA's covenants (size, height, color, material) and requires prior architectural approval.
- Swimming pool enclosures: You may install a pool enclosure that is black in color and made of transparent mesh in metal frames, as long as it meets state/local safety requirements. Any other enclosure must comply with HOA restrictions on color, size, height, and material, and needs prior architectural approval.
- Architectural review: The architectural review authority (ARC) reviews and approves improvements. ARC members cannot be current board members, their spouses, or household members. If your application is denied, you get a written notice explaining the denial and can request a hearing within 30 days; the board must hold a hearing within 30 days of your request.
- Violation hearings: If you're accused of a rule violation, you can request a hearing before the board. The HOA must give you a packet of documents/photos/communications at least 10 days before the hearing; if they don't, you get an automatic 15-day postponement. At the hearing, both sides get to present their case.
- HOA contracting & bids: For service contracts over $50,000, the board must solicit at least three bids unless there's an emergency or other exigent circumstances. The board doesn't have to pick the lowest bidder.
- What this document doesn't cover: This is a supplemental set of policies, not the full HOA rulebook. It doesn't include the main covenants (e.g., property use, maintenance, assessments, or pet rules) which are in the original Declaration recorded in 2018.
