What Avery Ranch Owners Association, Inc.'s governing documents say
Avery Ranch is a master-planned community in Austin, TX governed by a master owners association. This document amends the master rules and regulations, and applies to all lot owners (homeowners) in the community. It primarily covers rules for flags, solar devices, rain barrels, religious displays, record production, payment plans, voting, meeting notices, transfer fees, and email addresses.
- Flags: Only the U.S. flag, Texas flag, and official/replica armed forces flags are allowed. Display requires advance approval by the Architectural and Design Review Committee (ADRC) and must follow specific size, placement, and pole height rules (max 20 ft). Flags may not exceed 3'x5'. No more than one flagpole per lot, and flags displayed overnight must be illuminated with ADRC-approved lighting.
- Solar energy devices: Owners may install solar devices only on their lot, either on the roof (back side only, unless a variance is granted) or in a fenced yard/patio. Roof-mounted devices must not extend beyond the roofline and must be installed with ADRC approval. Ground-mounted devices must not exceed the fence height. A variance may be allowed if an alternative location would increase annual energy production by more than 10%.
- Rain barrels & rainwater harvesting: Rain barrels and rainwater harvesting systems require ADRC approval. They are prohibited on common areas and between the front of the home and the street. If visible from the street, another lot, or common area, the association may impose restrictions on size, type, materials, and shielding. Colors must match the home's color scheme.
- Religious displays: Religious items motivated by sincere religious belief may be displayed only on the main entry door or door frame, and must be no larger than 25 square inches in total. Items that contain patently offensive language/graphics or extend past the door edge are prohibited. The association may remove violating items without prior notice. Seasonal religious holiday decorations (e.g., Christmas lights/wreaths) are not subject to this section.
- Record production & retention: Owners may request association records by certified mail. The association must respond within 10 business days (or 15 if an extension is needed). Copy costs: $0.10/page, $1/CD, $3/DVD, labor $15/hr for requests over 50 pages. The association keeps contracts (4 years after expiration), owner account records (ongoing), meeting minutes (permanently), tax returns/audits (Permanent), financial books (2 years), and governing documents (permanently). Private information (violations, financial info, employee records) is exempt from production.
- Payment plans: Owners delinquent on assessments may request a Standard Payment Plan (6-month term) if they have not defaulted on a plan in the prior 24 months and request within 30 days of receiving a delinquency notice. The plan must have roughly equal monthly payments; the owner stays current on new assessments. The owner pays administrative costs; no late fees accrue during compliance. Default allows the association to proceed with collection.
- Transfer fees: A $250 transfer fee is due upon the sale or transfer of title of any lot, in addition to any resale certificate fee and any managing agent fee.
