What L T Estates Homeowners Association, Inc.'s governing documents say
This is a collection of policies and guidelines for the LT Estates Homeowners Association, a single-family HOA in Colleyville, TX. It supplements the community's Declaration of Protective Covenants and Bylaws, and it covers administrative procedures, architectural standards, and owner conduct. These rules apply to all homeowners in the association.
- Assessments & billing: Assessments are due on the first day of the billing period. Late payments accrue interest and late fees, and the association can add collection costs, suspend common-area use after 30 days' notice, and refer accounts to a third party or attorney. Owners may request a payment plan for past-due amounts, with terms up to 12 months (minimum 3 months), but the association is not required to offer a plan after the final notice period expires or more than once per 12 months.
- Architectural review: Many exterior changes require written approval from the Architectural Control Committee (ACC). Specific guidelines cover swimming pool enclosures (black, transparent mesh, max 6 feet), solar panels (rear roof preferred, must be approved), roofing materials (must match neighborhood aesthetics), rainwater collection devices (color consistent with home, not in front yard), and flag displays (one flagpole per lot, max 20 feet, flag size 3'x5', 15-foot setback).
- Landscaping & xeriscaping: Drought-resistant landscaping is allowed with ACC approval, but at least 25% of publicly visible area must be natural turf. Xeriscape areas must be bordered, maintained, and free of plants with thorns within 6 feet of sidewalks. No plants over 12 inches in the sidewalk strip, and no boulders over 6 inches between sidewalk and curb. Ornamental items in public view are limited to 4.
- Religious displays: Religious items may be displayed if they don't threaten public health or safety, aren't patently offensive, and aren't installed on common property or attached to traffic or utility fixtures. This policy overrides any conflicting restrictions in other governing documents.
- Records & inspections: Owners (or their authorized agents) may request to inspect or purchase copies of association records by sending a written request via certified mail. The association may charge production costs, and records of a specific owner's violation or payment history are not released without that owner's consent.
- Voting & meetings: The association controls all ballots and voting instruments. Voting instruments must be signed and dated, and can be submitted electronically, by mail, or in person. Proxies must be cast in person at the meeting. Board action may be taken by email or phone with a 72-hour reasonable opportunity for each director to respond.
- Conflict of interest: Contracts with a board member, their relatives, or companies they own (51% or more) require at least two other competitive bids, disclosure, and approval by a majority of non-conflicted directors. Contracts violating this policy are void.
