What Auburn Springs Homeowners Association, Inc.'s governing documents say
Auburn Springs is a single-family homeowners association (HOA) in Allen, Texas, governed by a set of recorded declarations, policies, and guidelines. This document is a supplemental filing that records several HOA policies and guidelines, not the full set of rules. It covers payment plans for delinquent assessments, records retention, solar panels, rain barrels, flags, religious displays, security measures, and architectural appeal procedures.
- Payment plans for delinquent assessments: The HOA offers payment plans for delinquent assessments, with a minimum repayment term of three months. Default occurs if a payment is missed or not paid in full, and the HOA may charge interest from the plan's approval date.
- Records retention and production: The HOA must retain and produce certain records (e.g., account records, contracts, minutes, tax returns) upon owner request. Owners pay copying costs: $0.10 per standard page, $0.50 per oversized page, $1.00 per CD, plus labor and programmer fees.
- Solar panels and roofing materials: Solar panels require prior written approval from the Architectural Control Committee. They must be on the owner's roof (not on common areas), not extend beyond the roofline, blend with the roof color, and be repaired within 120 days of damage. Ground-mounted systems must be screened and not on the front elevation.
- Rain barrels and collection devices: Rain barrels require prior approval from the Architectural Control Committee. They cannot be installed on common areas, must be enclosed to avoid mosquitoes, and must be screened or landscaped to minimize visual impact.
- Flags and flagpoles: Only U.S., Texas, armed forces, or college/professional sports team flags are allowed. Flagpoles must be between 12 and 20 feet tall, require prior approval, and must be maintained. Flags on poles attached to the dwelling cannot be larger than 3'x5'. Noisy halyards are grounds for removal.
- Religious displays: Owners may display religious items on their property, but they must be within 3 feet of the front facade, not extend above the roofline, and be no larger than 5'x3'x3'. A maximum of three displays is allowed, and most require prior approval unless they are smaller than 25 square inches on a door or door frame. Seasonal religious decorations are allowed 30 days before and 21 days after the holiday.
- Security measures: Owners may install security measures like cameras, motion detectors, and perimeter fencing, but they require prior approval from the architectural review body. Fencing cannot be barbed wire, razor wire, chain link, solid, board-on-board, vinyl, or electrically charged. The HOA is not liable for the effectiveness of security measures.
- Architectural decisions and appeals: If the architectural review authority denies an application, the owner must be notified in writing with the basis for denial and the right to request a hearing before the Board within 30 days. The Board must schedule a hearing with at least 10 days' notice, and may affirm, modify, or reverse the decision.
