What Creekbend Homeowners Association, Inc.'s governing documents say
This is the Second Amended and Restated Bylaws for Creekbend Homeowner's Association, Inc., governing a townhome community in Dallas, TX. The bylaws describe how the association is run—board elections, meetings, voting—and supplement the main declaration. They bind all homeowners (members).
- Leasing & rentals: Leases must have a minimum term of six months; short-term rentals are prohibited.
- Fees & assessments: A working capital assessment applies to new purchases. Annual, special, reserve, and individual special assessments are authorized, secured by a lien on the lot.
- Architectural review: An Architectural Control Committee (ACC) may be appointed; it has responsibilities including granting variances. Board members cannot serve on the ACC.
- Insurance: The Association must maintain a blanket policy covering townhomes and the Area of Common Responsibility. Owners must maintain policies for their own alterations, additions, betterments, improvements, and personal property.
- Dispute resolution: Disputes are mediated before litigation to avoid costly expenses and delays.
- Board of directors: The board has 3 to 5 members, all must be homeowners. Directors serve staggered two-year terms. Removal can occur by member vote or by other directors for specific reasons (felony, missing meetings, etc.).
- Meetings & voting: Annual meetings are held within first 90 days of the year. Quorum is 25% of votes. Members can vote in person, by proxy, absentee or electronic ballot. Special meetings can be called by 25% of members.
