What Ederville Park Townhomes Homeowners Association, Inc.'s governing documents say
This is an amendment to the declaration for Ederville Park Townhomes, a townhome community in Dallas/Fort Worth, Texas. It updates and adds rules about residential use and, most importantly, leasing — including a minimum lease term, a 12-month wait before renting after purchase, criminal background checks for tenants, and approval procedures. This is a partial document that amends specific sections; it does not contain the full community ruleset.
- Residential use: Lots may be used only for single-family, private residential purposes. No trade or business may be conducted in the residence, though limited home business activity is allowed if it doesn't change the character of the property or threaten safety. No rooming or boarding houses, and no renting of less than the entire residence as a separate housekeeping unit.
- Leasing & rentals: Leases must be for at least 12 months; transient or short-term rentals are prohibited. Owners must provide a copy of the lease and detailed tenant information to the association, including names, vehicle license plates, and criminal background reports. Owners who fail to comply may not lease their dwelling.
- Leasing limitation after purchase: New owners cannot lease their dwelling until 12 months have passed from the closing date or recording of the deed. Hardship exceptions may be granted by the board under specific circumstances, such as inability to sell, owner death, temporary relocation, leasing to immediate family, or military deployment.
- Tenant background restrictions: Owners may not lease to anyone convicted of serious crimes, including felonies involving crimes against persons, firearms, sex crimes, illegal drugs, robbery, murder, gang activity, gambling, alcohol, prostitution, theft, burglary, property destruction, or crimes involving minors. The association notes this is not a guarantee of tenant criminal history.
- Owner responsibility for occupants: Owners must ensure all occupants comply with the governing documents and are responsible for any violations or damages caused by tenants or occupants. Owners must provide lessees a copy of the governing documents.
- What this document doesn't cover: This is an amendment to an existing declaration, so it does not include the full set of association rules, such as assessments, maintenance responsibilities, architectural guidelines, or pet policies. Refer to the original declaration and other governing documents for complete rules.
