It is an ancillary document that binds the homeowners' association (Fort Worth LakePointe Homeowners' Association) to maintain an on-site stormwater detention pond at no expense to the city. This is not a full set of community rules; it covers only the stormwater facility obligations.
- Stormwater facility maintenance responsibility: The association must construct and maintain the detention pond (Facility) according to approved design plans and city standards, at no cost to the City of Fort Worth. Maintenance includes mowing, litter/sediment removal, vegetation control, and keeping the pond in 'good working condition'.
- Inspection and reporting: The association must inspect the Facility annually and submit an inspection report to the City. The City may also enter the property to inspect at any time. A log of maintenance actions and inspections must be kept and provided to the City upon request.
- City's rights and liens: If the association fails to maintain the Facility, the City may perform necessary repairs and charge the association for costs. Unpaid costs can result in a lien against association-owned lots.
- Indemnification and liability: The association agrees to hold the City harmless from any liability if the Facility fails to operate properly, including damages from flooding or slope failure.
