What Hills at Indian Creek Homeowners Association's governing documents say
This is a declaration of covenants, conditions, and restrictions for a single-family home HOA called Hills of Prestonwood Phase I, located in Plano, Texas. It binds all lot owners in this phase and is part of a larger master-planned community with a separate master association. The rules cover property use, assessments, architectural control, and maintenance obligations.
- What you own & maintain: You own your lot and the single-family home on it. You must maintain your home, lawn, and landscaping, and keep the sidewalk along your property in good repair. The association maintains common areas like greenbelts and open spaces.
- Assessments & fees: The annual assessment is initially $30 per lot per month, and can be increased up to 25% per year without member approval. Special assessments for capital improvements require approval by 67% of members. Unpaid assessments become a lien on your property and can be foreclosed.
- Architectural review: Any exterior improvement—including buildings, fences, pools, paint colors, and even mailboxes—must be approved in writing by the Architectural Control Committee before construction. The committee has 60 days to respond, and its decisions are final. Variances are possible but must blend with the community style.
- Use of property: Lots are for single-family residential use only. No temporary structures, no oil or mineral operations, no noxious activities, and no antennas or satellite dishes without committee approval. Trash must be screened from public view.
- Parking & vehicles: No trucks, campers, trailers, boats, or non-operable vehicles may be parked or stored on a lot or street for more than 12 hours, unless hidden from public view. Garage doors must be closed when not in use, and each home must have a two-car garage that opens to the side or rear.
- Pets & animals: Dogs, cats, and other household pets are allowed in reasonable numbers, but no commercial breeding. Horses, reptiles, pigs, chickens, and other farm animals are expressly prohibited.
- Leasing & rentals: The declaration does not restrict leasing or renting your home, but you are responsible for your tenants' compliance with all rules.
- What this document doesn't cover: This is a phase-specific declaration; the master community's rules and assessments are in a separate Master Declaration not included here. Also, this document does not specify any age restrictions or affordability requirements.
