What Light Point Pl Homeowner's governing documents say
This is the full set of bylaws for the Light Pointe Place Homeowners Association, a Texas nonprofit corporation governing a single-family home development in Dallas. These rules bind all lot owners, occupants, and users of the development, establishing how the HOA is run — board elections, meetings, rulemaking, and enforcement — not the specific use restrictions (which are in the Declaration).
- Board of Directors structure & elections: The board has 7 directors serving staggered 2-year terms; at least a majority must be members or spouses. Directors are elected by members at annual meetings. A director is ineligible if assessments are over 30 days delinquent or a violation remains uncured.
- Member meetings & voting: An annual meeting is held each March. Special meetings can be called by a majority of the board or by petition of at least 20% of lot owners. Quorum is 20% of lots (present in person or by proxy). A majority of votes cast at a quorate meeting binds all members, unless a higher percentage is required.
- Rulemaking process: The board may adopt, amend, or repeal rules by resolution, provided they do not conflict with law or the governing documents. At least 10 days' written notice of any rule change must be given to lot owners, who have a right to comment before the effective date.
- Violations, fines & enforcement: The board may impose reasonable fines (including daily/per-occurrence) and use self-help abatement after notice and a hearing. Fines cannot exceed a reasonable cap; unpaid fines cannot bear interest or be foreclosed as a lien alone. Immediate action allowed for self-evident or emergency violations.
- Owner obligations: Owners must pay assessments, comply with all governing documents, notify the board of any sale at least 10 business days before closing, provide contact info within 30 days of acquisition, and register mortgagee info. Failure to comply may affect voting rights.
- Records inspection & resale certificates: Members may inspect association books and records for a proper purpose, subject to board approval of the request. The association may charge a fee for resale certificates.
- Amendment process: Bylaws may be amended by members: approval of a majority of votes cast at a quorate meeting (unless the declaration requires more). Amendments must be in writing, signed by an officer, and delivered to lot owners at least 10 days before effective date.
