This is a set of restrictive covenants for Brookhaven, Phase One, a single-family residential subdivision in Bryan, Texas, recorded in 1983. It binds all lot owners in the subdivision, establishing rules for land use, building, and maintenance.
- Land use & building types: Most lots are restricted to single-family residential use, with a minimum heated area of 1,100 square feet. Lots 2, 3, and 4 are designated commercial and may be subdivided.
- Architectural review: All construction or alterations must be approved in writing by a five-member Architectural Control Committee, which reviews plans for quality, design harmony, and location. If no decision is given within 30 days, approval is deemed granted.
- Setbacks & facing: Buildings must comply with setback lines on the recorded plat. Corner lots must face the street with the greater setback unless the committee waives this.
- Nuisances & temporary structures: No noxious or offensive activity is allowed. Temporary structures like mobile homes, trailers, tents, or shacks cannot be used as residences.
- Signs & oil/mining operations: Signs visible from public view require committee approval. Oil drilling, mining, and related operations are prohibited.
- Pets & livestock: Raising livestock or poultry is prohibited. Dogs, cats, and other household pets are allowed if not kept for commercial purposes and not a nuisance.
- Yard maintenance & appearance: Lots must be kept clean and mowed. Garbage and trash cannot be burned. Clotheslines, woodpiles, and equipment must be screened from view. Vacant lots must be maintained, and the association can cut grass and charge the owner if not done.
- Firearms & enforcement: Discharge of firearms is prohibited. The covenants run with the land for 50 years, auto-renewing every 10 years, and can be enforced by any owner or the Wheeler Ridge Association.
