Lakewood Estates is a single-family home subdivision in Denton County, Texas, governed by a declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land. These rules bind all current and future property owners in the subdivision, and they cover architectural standards, land use, and maintenance expectations.
- Architectural review: Before building or altering any structure, plans must be approved in writing by an Architectural Control Committee (initially Gene Q. Smith, H.C. Kersey, and George E. Chapman) to ensure conformity and harmony of design. If the committee doesn't act within 30 days, approval is deemed granted.
- Construction & design standards: Only one single-family dwelling per lot, with a maximum of 1.5 stories (except split-level designs). Exterior walls must be brick, brick veneer, stone, stone veneer, or hollow tile, with up to 40% wood allowed. Minimum enclosed living area is 1,200 square feet (excluding porches, terraces, garages). Construction must be completed within 8 months of starting.
- Setbacks & location: The enclosed portion of a dwelling must be at least 30 feet from the front property line (except split-level or lakefront lots with committee approval) and at least 10 feet from side lot lines. Detached garages must match the main dwelling's construction and be at least 30 feet from the front line. No structure may be built below the 537-foot elevation.
- Land use & activities: No noxious or offensive trade or activity is allowed. Lots cannot be used as dumping grounds; trash must be kept in sanitary containers. No animals, livestock, or poultry may be raised or kept for commercial purposes, though dogs, cats, and other household pets are allowed as long as they aren't bred or maintained commercially.
- Fences & signs: Fences must be made of mesh wire, stripped poles, ornamental iron, or painted wood, and require written approval from the Architectural Control Committee. Only one sign per lot, no larger than 5 square feet, advertising the property for sale or rent (or builder signs during construction) is allowed.
- Temporary structures & utilities: No house trailers, tents, shacks, or temporary structures may be used as residences. Each dwelling must be connected to a septic tank or sewage disposal system approved by the County Health Department. Utility easements are reserved.
- Duration & amendment: These covenants run with the land for 30 years from recording (1961), then automatically renew for successive 10-year periods unless a majority of lot owners record an instrument to change them. Violations can be enforced by any property owner in the subdivision through legal action.
