What Villas of Rustic Woods Homeowners' Association's governing documents say
This is a set of governing documents for Rustic Woods, a single-family residential subdivision in Bedford, Texas, governed by a homeowners association (HOA). The documents include the original declaration of covenants, conditions, and restrictions (CC&Rs), a first amendment shifting maintenance responsibility for front yards from the association to individual owners, and a separate drainage easement maintenance agreement. These rules bind all lot owners and are relevant to current homeowners, prospective buyers, and renters.
- What you own & maintain: Each lot is for single-family residential use only, with one detached residence per lot (max 35 feet or 2 stories). Owners are responsible for maintaining their entire lot, including all structures, landscaping, and parking areas, and must keep the property neat and free of debris. The association maintains common properties like entry features and screening fences.
- Architectural review: No building, fence, wall, or exterior alteration (including paint, roofing, and landscaping) may be constructed or changed without prior written approval from the Architectural Control Committee. The committee reviews plans for design harmony, materials, and location, and may disapprove 'radical, curious, odd, bizarre, peculiar or irregular' structures. If the committee doesn't respond within 30 days, approval is deemed granted.
- Parking & vehicles: No boats, RVs, trailers, motor homes, or similar vehicles may be parked for storage in driveways, front yards, or on streets. Trucks over 1/2 ton and vehicles with painted advertisements cannot park overnight. Vehicles transporting flammable or explosive materials are prohibited. These restrictions don't apply to vehicles used for active construction.
- Pets & animals: Pets are allowed but must be restrained or kept in a fenced area or inside the house. Owners must keep lots clean of pet debris, and all animals must be vaccinated for identification. No farm animals (e.g., chickens, goats, pigs) are permitted.
- Landscaping & maintenance standards: Owners must keep lawns mowed and vegetation neat. No vegetables may be grown in front yards, and foundation plantings cannot grow above window bottoms. If an owner fails to maintain their lot, the association may enter the property, perform the work, and charge the owner for the cost.
- Assessments & liens: All owners must pay annual assessments to the association. Unpaid assessments become a lien on the property, accrue interest at up to 18% per annum, and may be enforced through foreclosure or personal collection. The association can suspend membership rights for delinquent owners.
- Use restrictions: Lots cannot be subdivided. No temporary structures (e.g., sheds, barns) are allowed except during construction. No signs are permitted except one professional 'for sale' sign (max 6 sq ft) or builder signs during construction. No oil drilling, mining, or commercial activities are allowed. Utilities must be underground.
- What this document doesn't cover: These documents do not specify the amount of HOA dues, rental restrictions, or age restrictions. They also do not describe any amenities like pools or clubhouses. The included drainage easement agreement only requires the property owner to maintain the drainage easement behind certain lots.
