Creekwood at Hidden Lakes Add is a subdivision of single-family lots within a master-planned community in Edgecliff Village, TX. This Development Area Declaration adds specific restrictions (e.g., minimum square footage, architectural control) on top of the Master Declaration. It governs lot owners and is enforceable by the Declarant (developer) and later the Master Association.
- Use restrictions: Lots are for single-family detached homes only; no mobile homes, trailers, apartments, or commercial use. Minimum livable area is 1,800 square feet (excluding garage, porches). No temporary structures or business/industrial activity.
- Architectural review: All exterior improvements (buildings, fences, retaining walls, mailboxes, satellite dishes) require written approval from the Master Architectural Committee. Roofing must be 240-pound asphalt shingle with weathered wood color. Fences must be wood, tubular, or approved masonry, not over 8 ft high, and no closer than 15 ft to front lot line.
- Pets: No more than two common household pets (dogs, cats, etc.) kept per lot. Pets must be leashed when outside the home; owners must clean up pet debris. No raising, breeding, or maintaining animals for commercial purposes.
- Parking & vehicles: Boats, trailers, RVs, and vehicles over 21 ft may not be parked for more than 24 hours in a 72-hour period unless concealed in a garage. Passenger cars, motorcycles, and pickups with current plates/inspection are allowed if in daily use. Construction vehicles temporarily parked are exempt.
- Fences & landscaping: Front yard fences must be at least 15 ft from the front lot line; side/rear fences max 8 ft high. Landscaping must include sodded front yard, grassed side yard (corner lots), and at least one 2-inch caliper tree in front yard. Landscaping projects must be completed within 30 days of commencement.
- Setbacks: Building setbacks vary by lot; see Exhibit B for specific distances from lot lines (e.g., 5 ft, 10 ft, 15 ft, 18 ft, 24 ft). No encroachments on adjoining lots.
- Enforcement & fines: Declarant may fine an owner $25 per day for continuing violations (after 15-day notice). Fines plus collection costs become a lien on the lot, enforceable by non-judicial foreclosure under Texas law. Failure to enforce does not waive future enforcement.
