What Southton Meadows Community Association, Inc.'s governing documents say
This document is a set of deed restrictions for a single-family home in the Southton Meadows subdivision, part of an affordable homeownership program (the Homebuyer Equity Leverage Partnership Program, or HELP) funded by the Federal Home Loan Bank of Dallas. It imposes income and resale restrictions on the property, not a general homeowners' association rulebook. It applies specifically to the property at 4204 Southton Mere and binds the current and future owners, not renters or the broader community.
- Affordability & income limit: The property is reserved for a low- or moderate-income household — defined as one earning 80% or less of the area median income, adjusted for household size. A direct subsidy of up to $17,000 was provided to help the owner buy the home.
- Resale restrictions (retention period): For the first 5 years after the subsidy disbursement date (starting March 25, 2022), the owner must notify the Bank before selling, transferring, or refinancing. If sold during that period, the owner must repay a pro-rata share of the $17,000 subsidy, reduced by 1/60 for each month they owned the home, unless the buyer is also low-moderate income or the repayment amount is $2,500 or less.
- Refinancing during retention period: If the owner refinances within the 5-year retention period, they must repay a pro-rata share of the subsidy, reduced by 1/60 per month owned, unless the property remains under a deed restriction or the repayment amount is $2,500 or less.
- Foreclosure & death: The deed restrictions end if the property is foreclosed on, a deed-in-lieu of foreclosure occurs, the FHA first mortgage is assigned to HUD, or the HELP-assisted homeowner dies. The Bank must be notified of any foreclosure during the retention period.
