This document sets out the rules for owning a home here, including architectural standards, use restrictions, and HOA assessments. It's aimed at current and prospective homeowners who need to know what's required of them.
- HOA membership & assessments: Every lot owner automatically becomes a member of the Point Noble HOA. The initial annual assessment is $1,200 per lot (or $100/month), payable once a house closes or title transfers for 12 months, whichever comes first. The board can adjust the rate and may levy special assessments for capital improvements or working capital.
- Architectural review: Before building, altering, or adding any exterior structure (including fences, satellite dishes, and solar collectors), you must get written approval from the Architectural Control Committee. The committee has broad discretion to ensure designs are harmonious and not 'unusual, radical, curious, odd, bizarre, peculiar, or irregular.' If they don't act within 30 days, approval is deemed given.
- Building & lot standards: Homes must be single-family detached dwellings, at least 4,500 square feet (6,000 on certain lots, 4,000 on others), with a garage for at least 3 cars. Roofs must be approved, composition shingles must be 300-pound or better and in 'weathered wood color' unless an exception is granted. Garages must be side or rear entry, with limited exceptions. Construction must be completed within 8 months for homes under 6,000 square feet, plus one month per additional 1,000 square feet.
- Use restrictions: Lots are for residential use only; no commercial, industrial, or institutional use. No temporary structures (trailers, tents, mobile homes) as residences. No livestock or poultry, but dogs, cats, and other household pets are allowed if not kept for commercial purposes. No exterior clotheslines, no aluminum foil on windows, and no picketing on the property.
- Parking & vehicles: No trucks, buses, or trailers may be parked on the street in front of a lot, except during construction. One camper, travel trailer, or recreational vehicle may be parked behind the front line of the house, and one pleasure boat with trailer may be stored in the open behind the front line. No vehicles may be parked in common maintenance areas or easements.
- Fences & walls: Fences cannot be built in front of the 50-foot setback line or the house setback line, whichever is greater. Retaining walls in front must be brick, concrete, or stone; railroad ties and landscape timbers are allowed only behind the rear house setback. Corner lots have additional restrictions. All fences must be approved by the Architectural Control Committee and maintained in sound condition.
- Signs & political signs: One 'For Sale' sign (max 2'x3', on a stake, no more than 3 feet high) is allowed. Political signs may be erected no more than 30 days before an election and must be removed within 5 days after results. Subcontractor signs are allowed temporarily. No signs that create controversy or ridicule are permitted.
