What Autumn Hills Estates Homeowners' Association's governing documents say
This is the Third Amended and Restated Declaration of Covenants and Restrictions for Autumn Hills Estates, a single-family home HOA in Fort Worth, Texas. It governs the 41 lots in the subdivision and applies to all current and future owners, who are automatically members of the homeowners' association.
- Assessments & fees: The annual assessment is $50 per owner (regardless of number of lots owned), due October 1 and delinquent if not paid by December 31. The board may propose a different amount each year, and special assessments may be levied with a simple majority vote. Unpaid assessments accrue interest at 10% per annum and are secured by a lien on the lot.
- Architectural review: All construction or external modifications to a lot must be approved in advance by the Architectural Control Committee (ACC). The ACC has broad discretion to approve or deny plans based on aesthetic quality, and may grant variances. Minimum living area is 1,800 square feet, and roof materials are restricted (e.g., no wood shakes or steel panels).
- Land use & structures: No trailers, tents, shacks, or temporary structures may be used as residences, and no old houses may be moved onto a lot. Detached or attached guest quarters under 1,500 sq ft may be allowed with ACC approval. No business may be conducted from a lot unless it is not detectable from outside.
- Animals & livestock: Livestock is prohibited except horses. A maximum of horses are allowed on lots of two acres or more; only one horse is allowed on lots under two acres, and the owner must maintain a permanent residence on the lot. No commercial breeding of animals is permitted.
- Parking & vehicles: Vehicles should be parked in a garage or driveway, not on lawns. Temporary overflow is allowed for parties or meetings. Recreational vehicles and similar vehicles are restricted (details are garbled in the text).
- Yard maintenance & appearance: Grasses must not exceed 8 inches in height along street frontage (exceptions for horse grazing). Flower gardens must have distinct perimeters, and weeds, dead foliage, and debris must be removed promptly. Fences must be maintained, and items that detract from aesthetics cannot be left in front of the house's front plane.
- Signs: Political signs up to 24 sq ft are allowed, but only one per candidate or issue, and they may be erected no more than 90 days before an election and must be removed within 10 days after. One 'for sale' or 'for lease' sign up to 5 sq ft is allowed while the lot is listed.
- Leasing & rentals: Owners may lease their residence, but the lease must be in writing, require the tenant to comply with the governing documents, and state that failure to comply is a default under the lease. All rules and sanctions apply to lessees as well as owners.
