Windmill Farms is a large master-planned community in Forney, Texas (Kaufman County), governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs). This document is a second amendment to that declaration, so it only shows changes and additions to certain rules—it is not the full rulebook. The community includes single-family residential lots, multi-family apartment areas, and commercial/retail land, each with its own set of rules.
- Document type & what to expect: This is a partial amendment to the Windmill Farms master CC&Rs, not the complete governing document. It modifies specific sections (e.g., definitions, assessments, architectural rules) but does not contain the entire set of community rules. - Annual assessments (single-family lots): Each owner of a single-family residential lot must pay an initial annual assessment of $495.00 per lot. The assessment may be increased by the Declarant or by a member vote. Increases greater than 50% require a majority vote of members.
- Special assessments: In addition to annual assessments, the association may levy special assessments for construction, unexpected repairs, or other expenses. More than one special assessment in a calendar year requires a member vote.
- Resale certificate fees: When selling a lot, the seller must request a resale certificate from the association. The association may charge a fee for this certificate, which is limited to the greater of the current annual regular assessment or applicable fees. Transfer-related fees are not covered by the association's assessment lien.
- Architectural review & structures: Rear yard structures (playhouses, dog houses, greenhouses, gazebos, pools, spas, cabanas, storage buildings) require prior written approval. If they exceed the fence height, they must be placed in the rear yard and screened from the street. Basketball goals: portable ones need written permission, must be kept in good repair and not use unsightly weights; permanent goals are prohibited without approval.
- Prohibited activities & nuisance: Hunting and shooting are not permitted anywhere on the property. Fireworks are strictly prohibited and subject to a monetary fine. Trash must be kept in sanitary containers out of public view, and screening requires prior approval. Drones and unmanned aircraft must comply with FAA rules and cannot take images of private property without consent. Use of the community's name or logo without permission is prohibited.
- Declarant control & development period: The Declarant (developer) retains significant control during the Development Period and Declarant Control Period (up to 50 years from recording). During this time, the Declarant appoints board members, can amend the declaration without owner consent for certain purposes, and has exclusive architectural control over vacant lots. Builders may be exempt from certain assessments and rules.
