This is a partially legible, ancillary agreement among the developer (Beazer), a second builder (Pulte), and the Miramonte Homeowners Association. It does not contain the community’s full rules. Instead, it modifies when annual assessments start for certain lots and gives Pulte a temporary veto over special assessments on its lots. Homeowners and buyers will need to refer to the actual Declaration of Covenants, Conditions, and Restrictions for the complete rulebook.
- Who this document is for: This agreement is between Beazer Homes (the original Declarant), Pulte Homes (a builder acquiring part of the development), and the Miramonte HOA. It does not directly create rules for individual homeowners or renters.
- Annual assessments start date: For lots within the 'Subject Property' (the portions owned by Beazer and Pulte), builders and other owners must begin paying maintenance fund assessments to the HOA when a final plat that includes those lots is recorded.
- Special assessments (temporary builder protection): As long as Pulte owns any lot in its portion (Pulte's Property), no special assessment can be levied against that lot without Pulte's prior written consent. This protection does not apply to individual homeowners unless they are successors to Pulte's interest.
