These policies supplement, but do not replace, the community's Declaration of Covenants, Conditions and Restrictions.
- Record retention: The association must keep its formation documents, bylaws, and covenants permanently; financial books and records, board and owner meeting minutes, and tax returns for at least 7 years; current owner account records for 5 years; and contracts lasting one year or more for 4 years after expiration.
- Payment plans for overdue assessments: Owners can request a payment plan for delinquent regular or special assessments, with a minimum term of three months. The board may require a written agreement, and an owner is ineligible if they defaulted on a plan in the previous two years or are currently in foreclosure.
- Access to association records: Owners may inspect and copy association books and records, except for certain confidential items like attorney files, personal information of other owners, violation histories, and payment records. Copying costs follow Texas Administrative Code Rule 70.3, and a written request must be submitted; the association must respond within 10 business days.
- Contract bidding: For contracts over $50,000, the board must seek at least three bids unless it's an emergency, changing vendors would void warranties, or only one vendor is qualified. The board can accept a higher bid if justified, and conflicts of interest require disclosure and recusal.
- Covenant enforcement and fines: The association can fine owners for violations of the rules, covenants, and policies. Fines escalate per violation: $50 for the first, $100 for the second, $150 for the third, and $200 for each subsequent, with 30 days to cure each time. Owners have a right to a hearing before fines are final, and the board may waive or vary fines case-by-case.
