What The Village at Macarthur Commons's governing documents say
The Village at MacArthur Commons is a single-family home HOA in Irving, TX. This document is an amendment to the association's governing documents, not the full rulebook. It updates rules on assessment collection, architectural setbacks, board powers, and amendment procedures.
- Assessment Liens & Foreclosure: Unpaid assessments become a continuing lien on the lot. The HOA can foreclose (judicial or non-judicial) after 30 days delinquency. Interest accrues at 18% per annum or the maximum non-usurious rate. The lien is superior to all others except tax liens and first mortgages.
- Late Fees & Fines: Late fees on assessments cannot exceed $25 per day. Fines for rule violations are capped at $25 per day per violation. A member may request a hearing to suspend the fine. Fines are treated as special assessments.
- Architectural Setbacks: Minimum setbacks: front 20 ft from street property line, rear 10 ft from alley line, side 5 ft from interior lot lines, corner side 15 ft from public street, side facing alley 5 ft. Storage structures limited to 100 sq ft, must not be visible from a public street, max height 8 ft (or height of existing fence, whichever is higher).
- Board Powers: The Board may adopt rules, manage common property, set assessments (annual and special), collect delinquencies, levy fines, enter contracts, and enforce the declaration. The Board can also borrow money or mortgage common property only with 51% member approval.
- Amendment & Termination: The declaration can be amended or terminated by 51% of members voting in person, by proxy, or by written/electronic ballot. Amendments become effective as determined by the Board. Bylaws can be amended by the Board under the Texas Business Organizations Code.
- Common Property & Easements: The Association has easements for enjoyment of common property, which can be suspended during delinquency or for up to 30 days for rule infractions. Sale or mortgage of common property requires 51% member approval.
- What this document doesn't cover: This amendment does not address leasing restrictions, pets, parking, or age restrictions. For those rules, refer to the full Declaration and Bylaws.
