What Tokalaun Park & Estuary's governing documents say
Tokalaun Park & Estuary is a single-family residential subdivision in Lucas, Texas, governed by restrictive covenants that run with the land. These rules bind all lot owners and are enforced by an Architectural Control Committee (ACC) until the last lot is sold, after which a Homeowners Association takes over. The covenants are detailed and strict, focusing on architectural standards, construction requirements, and property maintenance.
- Architectural review: All construction, modifications, fences, pools, landscaping, and even mailboxes require written approval from the Architectural Control Committee (ACC). The ACC has broad discretion and can grant variances with a two-thirds vote. Plans must be submitted and approved before work begins.
- Construction standards: Homes must be at least 3,500 square feet (2,000 sq ft on ground floor for two-story), have a garage for at least three cars, and use brick, stone, or stucco on at least 80% of exterior walls (70% on back wall). Roofs must be wood shingle, tile, or composition shingle of a certain weight. Construction must be completed within one year.
- Lot use & occupancy: Lots are for single-family residential use only. No duplexes, apartments, or business use, except home offices that don't affect neighbors. Secondary dwellings for extended family are allowed. No mobile homes, tents, or temporary structures.
- Setbacks & building lines: Buildings must be at least 50 feet from front property line, 35 feet from side, and 20 feet from back, unless approved by the ACC. On cul-de-sac or corner lots, structures must be at least 70 feet from the road centerline.
- Pets & animals: Only dogs and cats are allowed as pets, in reasonable numbers, and not for commercial breeding. No livestock, poultry, or other animals. Horses are prohibited.
- Parking & vehicles: No on-street parking on Blondy Jhune Road at any time. Trucks over 3/4 ton cannot park overnight on streets, driveways, or lots. Campers, trailers, RVs, and boats must be garaged or screened from view. Inoperable vehicles without valid plates and inspection stickers must be screened.
- Signs & antennas: Only one professional 'for sale' sign (max 5 sq ft) is allowed. Ham radio antennas are prohibited. Satellite dishes visible from public areas are not allowed, except small (under 24") dishes with ACC approval.
- Homeowners association dues: Each lot owner must pay $1,000 per lot into a beautification fund, plus $250 per year (due Jan 2) for ongoing maintenance. Annual increases are capped at 10% per year unless approved by majority vote. Unpaid assessments accrue 18% interest and can lead to liens.
