This is a drainage channel maintenance agreement for the Eagle Mountain La Frontera HOA community (Mansfield, TX). It is an ancillary document that obligates the developer, HOA, and future owners to maintain an on-site storm water drainage facility. It is not a full set of HOA rules; typical homeowner rules (pets, leasing, assessments, age restrictions, etc.) are not addressed here.
- Drainage facility maintenance: The landowner, its successors, and assigns (including the HOA) must construct and maintain the on-site drainage facility at no expense to the City of Fort Worth. Maintenance must follow design specs and City standards, keeping the facility in good working condition.
- Inspection & reporting: The responsible party must inspect the facility annually and submit an inspection report to the City. The City may also enter the property to inspect and can direct repairs if deficiencies are found.
- Liability & indemnification: The landowner/HOA agrees to hold the City harmless for any liability if the facility fails to operate properly, including flooding, slope failure, or channel malfunction. The City is under no obligation to maintain the facility.
- Restrictions on building: No habitable building may be erected within the drainage channel outlined in Exhibit A. Any building abutting the easement must have a finished floor at least two feet above the 100-year flood water depth in the detention pond.
- What this document doesn't cover: This document does not contain the community's general HOA rules (e.g., pet limits, rental restrictions, architectural guidelines, assessment amounts, age restrictions). Those would be in the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) or other separate governing documents.
