What Veridian Point's governing documents say
This is a first amendment to the Declaration of Covenants, Conditions and Restrictions for Veridian Point, a single-family residential subdivision in the extra-territorial jurisdiction of Burleson, Texas. It updates the original HOA rules to comply with recent Texas laws, and it binds all homeowners in the community. This document is a partial amendment, not the full rulebook, so it only covers the specific items listed.
- Assessments & fees: The HOA can only collect regular assessments if the Declaration authorizes them and is filed in the county records. Resale certificate fees are capped at $375, and updated certificates at $75; the HOA must deliver a resale certificate within 5 days of a second request, or face a penalty of up to $5,000.
- Religious displays: The HOA cannot prohibit owners from displaying religious items on their property, but it can regulate items that threaten public health/safety, are obscene, or violate building lines, easements, or setbacks.
- Swimming pool fences: The HOA cannot ban swimming pool enclosures that meet state/local safety requirements, but it can regulate their appearance (e.g., colors). A black transparent mesh enclosure up to 6 feet high and non-climbable must be allowed.
- Security measures: The HOA cannot prevent owners from installing security cameras, motion detectors, or perimeter fencing on their own property, but it can ban cameras in common areas and regulate fencing types.
- Management & transparency: The HOA must post current governing documents online if the subdivision has at least 60 lots or contracts with a management company. It must file a management certificate with TREC and provide contact info and fee details. Owners are not liable for attorney's fees for assessment collection if the certificate isn't filed.
- Architectural review (ACC): During the developer control period, ACC members cannot be board members, their spouses, or household residents. Owners can appeal ACC denials to the board, which must hold a hearing within 30 days, with notice at least 10 days prior. Both sides can postpone once for up to 10 days, and audio recording is allowed.
- Board meetings & contracts: The board must give at least 144 hours' notice for regular meetings and 72 hours for special meetings. Contracts over $50,000 require competitive bidding.
- Enforcement & credit reporting: The HOA must send a 209 notice before reporting delinquencies to credit bureaus, and give owners 45 days to cure before further collection. It cannot report disputed charges, and must offer a payment plan. Owners can sue in justice court for 209 violations.
