What The Reserve at Westridge Owners Association's governing documents say
The Reserve at Westridge is a master-planned, single-family-home community in McKinney, Texas, still under development by D.R. Horton. These documents – supplements recording newly platted phases (Appendices B-1 and B-3), the Community Bylaws (which govern the owners association), and a fiscal-year amendment – together form the rulebook for lot owners and residents. They define how the association is run, what owners must do, and set up the developer's control until build-out.
- Who the rules bind: All present or future lot owners, and anyone who uses or occupies a lot, must follow the Community Documents. Just buying or moving in means you accept the rules.
- Developer (Declarant) control: D.R. Horton-Texas, Ltd. is the Community Declarant. During the Declarant Control Period and Development Period, the Declarant has special rights, including the power to appoint and remove directors and to unilaterally amend the Bylaws in certain ways. The Declarant's rights are spelled out in Appendix F of the Community Declaration, which overrides these Bylaws during those periods.
- Board of Directors: After the Declarant Control Period, the Board will have 5 directors, each serving a 2-year staggered term. To be eligible, a person cannot be delinquent on assessments more than 30 days or have an uncured rule violation. Co-owners of the same lot cannot serve at the same time.
- Assessments & obligations: All owners must pay assessments levied by the association. An owner is not in good standing (and may lose voting rights) if assessments are unpaid. The association can file a lien for unpaid assessments, but cannot foreclose based solely on fines.
- Rules & enforcement: The Board can adopt and amend rules for the community. Before fining or suspending common-area use for a violation, the owner must receive written notice, a description of the violation, a cure period, and the right to a hearing. Certain urgent actions (e.g., to prevent immediate harm) are exempt from these notice and hearing requirements.
- Meetings & voting: The association must hold an annual meeting. Special meetings can be called by a majority of the Board or by petition of owners of at least 10% of the lots. Owners eligible to vote must be current on assessments. At meetings, each lot generally has one vote unless the Declarant holds multiple lots.
- Sale & disclosure: An owner selling a lot must notify the Board of the sale, buyer, closing date, and title/agent info at least 10 days before closing (or when requesting a resale certificate). The association can charge a fee for preparing resale certificates under Texas Property Code Chapter 207.
- What this document doesn't cover: These documents are the Bylaws and plat supplements; they do not contain the full set of use restrictions, architectural rules, or specific assessment amounts. Those would be found in the Community Declaration (the main CC&Rs) and any separate rules adopted by the Board.
