What Shaddock Creek Estates Ph 1-4 HOA's governing documents say
Shaddock Creek Estates Phases 1–4 is a single-family homeowners association (HOA) in the Frisco/Plano, Texas area. This document is not the full CC&Rs — it is a recorded set of two HOA policies: one on enforcing covenants and fining violations, and one on collecting assessments and fees. It applies to all property owners in the subdivision.
- Enforcement & fines: The HOA can fine owners for violations of the governing documents, including unapproved changes, poor maintenance, vehicles, trash, and other items on a common violations list. Initial fines start at $50 and each single fine cannot exceed $500, but new fines can be imposed daily for continuing violations with no overall cap. Repeated violations of the same rule within six months can lead to doubled fines.
- Violation process & hearings: Owners generally get a courtesy notice and 14 days to cure before a formal Notice of Violation. Uncurable or health/safety violations can be fined immediately. Owners may request a hearing within 30 days of the Notice of Violation; the hearing is held before the board, and the board must provide evidence documents 10 days beforehand.
- Assessment due dates & late charges: Assessments are billed annually and due January 1; they become delinquent January 30 at 5:00 p.m. Late charges are at least $25 per month, plus an 18% annual interest rate, and returned checks incur at least a $25 fee.
- Collections & liens: The HOA follows a series of collection steps: reminder, association demand letter, attorney demand letter, then a lien. A lien is not filed until at least 90 days after the association's demand letter, and foreclosure may follow. Owners can also be suspended from using amenities (pool, community center, pavilion) for unpaid amounts.
- Payment plans & fee waivers: Owners who are behind can request a payment plan of 3 to 18 months, subject to eligibility (no prior default within 2 years) and all violations being resolved. The HOA may waive some late fees and interest for extenuating circumstances, but only once every 24 months and not for out-of-pocket collection costs.
