What Brookhollow Owners' Association, Inc.'s governing documents say
This is a set of administrative policies and resolutions for the Brookhollow Allen Residential Association, an HOA in Allen, TX, that governs a single-family subdivision. It includes the association's management certificate, collection and violation procedures, payment plan rules, architectural guidelines, and records policies. These rules bind homeowners (lot owners) and are not the full declaration of covenants.
- Collection of assessments: Delinquent accounts incur a $20 monthly collection fee, a $50 title search fee at stage 3, and a $150 escalated collection fee at stage 4. NSF checks are charged $25. Payment plans are available for eligible owners with a minimum 3-month and maximum 12-month term (or up to 18 months from request); accounts under $300 can be paid in up to 6 monthly installments, accounts over $300 require a 25% down payment and remainder in installments. Attorney fees and foreclosure may follow.
- Violation enforcement: Violations are addressed with a 10-day courtesy notice and a 30-day certified notice; if uncorrected, the account is sent to the association's attorney. For long grass, a 10-day notice warns that the association will cut the grass and bill the homeowner. Attorneys' fees and costs are the homeowner's responsibility and may lead to a lien.
- Architectural review & improvements: Prior written approval is required for solar panels (preferably on rear roof unless 10% energy loss is documented; must be below fence line if not on roof), roof shingles (must match aesthetics), flagpoles (max 20 ft, one per lot, 3x5 ft flag), and rain barrels (must match home color, not between home and street). Religious displays are allowed on entry door/frame, limited to 25 sq in, and must not be offensive.
- Flag display: American, Texas, and armed services flags are encouraged. One flagpole per lot, max 20 ft, flag size max 3x5 ft. Must be maintained, conform to setbacks, and abate noise from halyards. Illumination requires approval.
- Rain barrels & water harvesting: Allowed with approval. Barrels must match home color, not be visible between home and street, and have sufficient space on the lot. Association may regulate size, type, materials, and screening if visible from street or common area.
- Religious displays: Allowed if motivated by sincere religious belief. Limited to 25 sq in, placed only on entry door or door frame, not extending past frame. Must not threaten safety or be offensive. Association may remove nonconforming items.
- Records inspection & voting: Owners may request records by certified mail, paying estimated costs (labor, copies). Records are retained per schedule (e.g., financial records 7 years, owner accounts 5 years). Voting instruments must be signed, can be submitted electronically or by mail, and proxies must be cast in person.
- What this document doesn't cover: This is a partial document—it does not include the full declaration of covenants, bylaws, or assessment amounts. It only contains specific administrative policies and architectural guidelines adopted by the board. Prospective buyers should obtain the complete governing documents and a resale certificate.
