Bryan Village is a 15-unit condominium community in Richardson, TX. You own your individual unit and share ownership of the building's common elements (land, foundations, roofs, utilities, driveways, etc.). The Bryan Village Homeowners Association manages the property, carries master insurance, and levies assessments to cover common expenses.
- What you own & maintain: You own your unit's interior and garage (if attached as part of the unit) and are responsible for maintenance, repair, and replacement of all components inside your unit, including fireplaces, utility lines, and HVAC equipment that serve only your unit. The Association maintains the general common elements (land, foundations, roofs, central utilities, driveways, grounds) and limited common elements (patios, balconies, yard areas, parking spaces) – though you are responsible for routine cleaning and maintenance of your patio/balcony, while the Association replaces paving, fences, and exterior surfaces.
- Parking & vehicles: No vehicles, boats, campers, or trailers may be parked anywhere in the Condominium Project except in designated garage areas or designated parking areas (as shown on the Condominium Subdivision Plan). Parking on driveways or walkways is prohibited.
- Occupancy limits: As amended in 1983, the maximum number of persons over age 18 allowed to occupy a two-bedroom unit is four (increased from three).
- Assessments & fees: Each unit pays 6.66% (1/15th) of the total assessments, regardless of limited common element use. Assessments are due as determined by the Board; if unpaid, they incur 15% annual interest and a late charge of up to 5% of the installment if not paid within 30 days of the due date. The unit owner is personally liable, and unpaid assessments can be collected from sale proceeds.
- Voting & governance: Each unit is entitled to one vote (amended in 1995 from a percentage-based system). The Board of Directors consists of three persons who must be co-owners (or their designated agents if a legal entity) and must reside in the project unless appointed by the Developer. A quorum requires 66 2/3% of the voting power present in person or by proxy. A majority of votes cast decides most questions.
- Architectural review: Co-owners may redecorate, landscape, or improve their patio or balcony areas only in accordance with architectural guidelines promulgated by the Association. No improvement may impair the structural integrity or aesthetic harmony of the project as observable from outside the unit.
