The declarations are ancillary to the purchase contract and run with the land for a limited term.
- Mandatory arbitration: All disputes with the builder (including construction defects, contract claims, and property issues) must go through mediation first, then binding arbitration under the AAA rules. Fees are capped for buyers (builder pays up to certain amounts), and a panel of three arbitrators may be required.
