Randol Mill Park Garden Homes is a townhome/garden home community in Arlington, TX — each lot owner owns their home and land, with shared party walls and common areas maintained by the HOA. The HOA sets rules on use, appearance, and assessments that bind all lot owners.
- Assessments & fees: Annual assessment was $540 for 2004, can increase up to 10% per year without a membership vote; increases above 10% require a 2/3 vote of members present. Assessments are due monthly (1/12th), and unpaid amounts incur late charges, 10% annual interest, and a lien on the property.
- Use restrictions: Lots are for residential use only — no commercial or professional business allowed. No temporary structures, trailers, or outbuildings as residences. Outside storage is prohibited except inside private courtyards or garages. No inoperable vehicles; garage doors must remain closed. No Owner may cut through a party wall. The HOA maintains grass and landscaping between the curb and the front wall/fence; owners maintain rear yards, patios, and interior courtyard space.
- Insurance requirements: Each Owner must carry a Texas Standard Form homeowner's policy with replacement cost coverage on their home. If they fail to do so, the Association may purchase insurance and bill the owner. The Association also carries liability insurance ($1M minimum), property insurance on common area improvements, and an errors & omissions policy for directors.
- Common area & amenities: The common area (Lot 30, Block A) includes buildings, recreational facilities, swimming pool, landscaping, and utility lines. Owners have an easement to use the common area, subject to HOA rules, fees for recreational facilities, and suspension of rights for non-payment or rule violations.
- Enforcement & amendments: The Association or any Owner may enforce covenants through legal action. Amendments require a 52% quorum and 2/3 vote of those present during the first 20 years; after 20 years, amendments may be made with consent of 52% of all Lot Owners. The declaration automatically renews every 10 years after the initial 20-year term.
