This document is a Collection Policy and Payment Plan Guidelines for the Bentley Manor Homeowners Association (HOA) in San Antonio, TX. It is an ancillary document that supplements the main Declaration of Covenants, Conditions and Restrictions for Shavano Park Subdivision Units 17-A and 17-E. It applies to homeowners (owners) and details how the HOA collects assessments and handles delinquencies. Two amendments are also included: one removes the Declarant's right to annex additional property, and the other deletes provisions related to shared maintenance of Lockhill-Selma Median.
- Assessment due dates & delinquency: Annual assessments are due January 1 and payable quarterly on the 1st of January, April, July, and October. If any quarterly payment is late, the entire remaining unpaid assessment becomes immediately due and delinquent. Interest accrues at 10% per annum after 30 days delinquency.
- Delinquency notices & hearing rights: A Past Due Notice may be sent 30 days after the due date, and a Final Notice by certified mail after 60 days. Owners have 30 days from receipt of the Final Notice to request a hearing before the Board; if no hearing is requested, common area privileges may be suspended and the account may be turned over to a collection agent or attorney.
- Payment plan options: Owners can request a payment plan for delinquent assessments. The number of equal payments depends on when the delinquency first occurs: 6 payments if delinquent in February, 5 if May, 4 if August, 3 if November. A longer plan may be requested in writing. The Association may deny a plan if the owner defaulted on a previous plan within the past 2 years. A $20/month administrative fee applies during the plan.
- Collection actions & foreclosure: If delinquency continues, the Association may refer the account to an attorney, file a lawsuit, or pursue expedited foreclosure (with a court order). The Association has discretion to evaluate each case individually.
- Application of payments: Payments are applied first to delinquent assessments, then current assessments, then attorney/collection costs, then fines, then other amounts. If an owner defaults on a payment plan, payments are applied in a different order: costs, attorney fees, interest, late fees, delinquent assessments, current assessments, fines.
- Amendments to the Declarations: The Second Amendment (2020) deletes the Declarant's right to annex additional property. The Third Amendment (2020) deletes all provisions related to shared maintenance of the Lockhill-Selma Median and the associated maintenance fund. Both amendments were approved by 67% of member votes.
