What Essex's governing documents say
This is a partial governing document for Lincoln Pointe, a single-family homeowner's association (HOA) in Van Alstyne, Texas. It contains two adopted policies: a Covenant Enforcement and Fine Policy and a Collection and Payment of Assessments Policy, but not the full declaration of covenants, conditions, and restrictions (CC&Rs) or bylaws. This document binds all owners and their successors.
- Enforcement process: The association can enforce violations through a stepped process: initial notice (typically 14 days to cure), then a notice of violation, then a notice of fine and/or corrective action. Repeated violations trigger escalated steps, and owners can request a hearing before the Board within 30 days of the notice, with the hearing held within 30 days of the request and notice given at least 10 days prior.
- Fines: The initial fine for a violation is at least $50, but the maximum fine is $1,000. Additional fines can be imposed at $50 per week for continuing violations until the cap is reached. Repeated violations of the same rule within six months can result in doubling the fine.
- Corrective action: If a violation is not cured, the association may hire contractors to fix it, with at least 3 days' notice (except for emergencies) and charge the owner for costs. The owner is also responsible for any fines and enforcement costs, and failure to pay may result in a lien on the property.
- Assessment collection: Assessments are billed annually and due on January 1st; any amount not paid by the delinquency date incurs a $25 late charge plus 18% annual interest. The collection process includes a reminder statement, an association demand letter (allowing at least 45 days to pay), an attorney demand letter, and ultimately a lien and possible foreclosure.
- Payment plans: Members facing financial hardship can request a payment plan for assessments and other charges. Plans must include a schedule with equal monthly payments, ranging from a minimum of 3 months to a maximum of 18 months, and are not available if the member defaulted on a prior plan within the previous two years.
