This is the Amended and Restated Bylaws for Meeting Street Owners Association, Inc., a Texas homeowners association (HOA) in Tarrant County. The document governs how the association is run—board elections, meetings, enforcement, and assessments—and applies to all property owners in the community. It is a procedural rulebook, not the full set of community rules (which are in the Declaration).
- Association governance & meetings: The HOA is run by a Board of Directors (currently 3 members, with 2 selected by the developer during the Declarant Control Period). Annual owner meetings must be held by December 15, and special meetings can be called by owners holding at least 5% of voting power. A majority of votes (quorum) is needed for official action.
- Board elections & terms: After the developer's control ends, owners elect directors for staggered terms (1, 2, and 3 years initially, then 3-year terms). At least one-third of the board must be elected by non-developer owners. Directors serve without pay but can be reimbursed for expenses.
- Enforcement & fines: The Board can impose fines up to $300 per violation and suspend use of common areas for up to 60 days for rule violations. Before any sanction, the owner gets written notice, a chance to cure (unless a similar violation occurred in the last 6 months), and an opportunity for a hearing. If the owner doesn't comply after a ruling, the Board can fix the problem and charge the owner.
- Assessments: Each owner must pay annual and special assessments as described in the Declaration. Unpaid assessments become a lien on the property. Owners cannot avoid assessments by not using common areas or abandoning their lot.
- Owner rights & records: Owners have the right to inspect association records (financial and meeting minutes) at reasonable times, subject to rules on notice and copying costs. Certain private information (like payment history or contact details) is protected.
