Villages of Stonegate is a single-family homeowners' association (HOA) in Westover Hills, TX. This document is a partial amendment (the Fifth Amendment) to the community's governing documents. It updates only two sections: one on speeding and traffic violations, and another on enforcement remedies and procedures. It does not set out the full set of HOA rules.
- Speed limit & traffic rules: The posted speed limit within Stonegate is 20 miles per hour. The Board of Directors may change the speed limit or adopt additional traffic rules. The Board may rely on credible reports from residents to enforce violations; the violator does not have to be witnessed by an association representative. Repeat-offender guests or vendors may have their access to the community denied by gate security.
- Enforcement & fines: The association may enforce the governing documents through monetary fines (which become part of the owner's assessment obligation and can be secured by a lien), suspension of services for assessment delinquency over 30 days, self-help (including removal of nonconforming structures), recording a Notice of Violation, filing a lawsuit, or charging the owner for property damage. Before taking enforcement action, the Board must give the violator notice and an opportunity to be heard in accordance with Texas law (Sections 209.006 and 209.007). The association may recover attorney's fees and court costs.
