What Westpoint Two's governing documents say
Westpoint Two is a single-family home subdivision in Euless, Texas. The Declaration of Covenants, Conditions and Restrictions (CC&Rs) bind all lot owners and were originally filed in 1992. An Architectural Control Committee (ACC) reviews and approves all exterior improvements to ensure uniformity. Key restrictions cover building standards, setbacks, vehicle parking, pets, signs, and lot maintenance.
- Architectural review: No building, wall, structure, or exterior improvement (including retaining walls, trellises, and permanent borders) may be constructed without prior written ACC approval of plans, specifications, and a plot plan. The ACC must approve or disapprove within 30 days.
- Construction & building standards: Only detached single-family homes for residential use are allowed, no mobile homes, trailers, or commercial uses. Minimum livable area is 1,100 sq ft (excl. open porches and garages). Exterior walls must be masonry, masonry veneer, or stucco unless approved otherwise. Maximum height is 2.5 stories. Front setback minimum is 20 ft, side setback 5 ft (15 ft on corner lots), rear setback 15 ft.
- Parking & vehicles: No vehicle, boat, trailer, or recreational vehicle may be parked or stored on any lot for more than 24 hours in any 72-hour period unless it is under 21 ft and fully concealed inside a garage. Exception: passenger cars, vans, motorcycles, and pickups in operating condition with current plates and inspection stickers, and in daily use.
- Pets: No animals, livestock, or poultry may be bred or kept on any lot, except customary household pets (e.g., dogs, cats) — maximum two of each type per lot, not for commercial purposes. Pets must be restrained inside a rear fenced area or within the home; when off the lot, they must be leashed.
- Signs & advertisements: No signs, billboards, or advertising structures except one 'For Sale' sign not to exceed 6 sq ft. The ACC or Declarant may remove noncompliant signs without liability.
- Antennas & satellite dishes: No electronic antenna or satellite dish may be erected if visible from any street or off-lot ground location, unless properly screened with prior ACC approval. No antenna may be free-standing or extend above the highest roof point, or be located forward of the front building line.
- Lot maintenance: Owners must keep grass and weeds cut, edge curbs, and maintain the lot in a sanitary and attractive manner. No dumping or storage of trash or materials in public view. Clothes drying lines must be screened. Window/wall air conditioners visible from the front are prohibited. Building materials must be removed promptly after construction.
- Duration & amendments: The restrictions run with the land for 40 years from the date of declaration (1992), automatically renewing for successive 10-year periods unless changed by a majority of lot owners. Amendments require an instrument signed by Declarant or by 2/3 of lot owners (until 1997, Declarant alone).
