Timber Lakes Estates is a single-family lot homeowners association (HOA) in Heber City, Utah — you own your lot and the home you build on it. This document is the community's main rulebook, which binds all lot owners and their tenants. It covers property rights, exterior maintenance, architectural control, permitted uses, assessments, and a detailed set of construction regulations.
- What you own & maintain: You own your lot (the land) and are responsible for all improvements on it, including exterior maintenance. The association maintains the common areas (recreation facilities, roads, open space) and carries insurance on them.
- Architectural review: All structures, additions, fences, walls, retaining walls, and exterior color changes must receive written approval from the Association's Architectural Committee before construction begins. Plans must include elevations, materials, and color samples. Application fees and a construction bond (based on square footage) are required. Unapproved work may result in fines, liens, or legal action.
- Construction & building standards: Minimum dwelling main-floor size: 900 sq. ft. Maximum building height: 35 feet above natural grade. Roof slope minimum 4:12, fire-resistant roofing required. Exterior materials allowed are logs, natural wood siding, fiber cement board (wood grain), rustic steel, and stone. No T-111, aluminum, galvanized, stucco, or vinyl siding. Exterior colors must be natural earth tones (Sherwin-Williams reflective index 10–60 approved by rule; others individually reviewed). White and black as main siding colors prohibited. Accessory structures limited to 75% of primary dwelling footprint and 75% of its height, max 2,000 sq. ft., must match primary structure materials and colors.
- Setbacks & lot use: Buildings must be at least 60 feet from road centerline or 30 feet from property line (whichever is greater), 20 feet from side lot lines, and 30 feet from rear lot lines. No outdoor toilets or clotheslines without approval. No open fires; all chimneys must have spark screens. No cutting of live trees without written consent except for roads or utilities.
- Pets & animals: No animals, livestock, or poultry may be raised, bred, or kept for commercial purposes. Dogs, cats, and other household pets are allowed but must not become a nuisance. The association may require written consent for exceptions.
- Leasing & rentals: This document does not restrict lease terms or require registration of tenants — refer to a separate rental policy or later amendments. Residents who are tenants may use common area facilities at the owner's delegation.
- Assessments & fees: Every lot owner pays annual assessments and may be charged special assessments for capital improvements. The maximum annual assessment as of this document was $65 per lot, adjustable up to 10% yearly without a vote; above 10% requires a 2/3 member vote. Unpaid assessments accrue 12% annual interest after 90 days and become a lien on the property. Filing fee for plans: $20 per project.
