What Aspen Mountain Property Owners Association's governing documents say
Aspen Mountain is a single-family-home subdivision in Oakley, Utah, governed by a mandatory homeowners' association. Every person who owns a lot is automatically a member. This is the full set of rules for the community — what you can build, how you can use your land, and what the association requires of you.
- Residential use only: All lots are designated for single-family dwellings only. No commercial trade or business is allowed on any lot, including renting or leasing the dwelling. Home-based offices not requiring public access are permitted if they comply with local home-occupation ordinances.
- Building & lot requirements: Minimum ground-floor size is 672 sq. ft. for a single-level dwelling or 550 sq. ft. for a multi-level dwelling. Maximum height is two stories from the upslope elevation and three stories from the downslope side. Exterior must be finished within 27 months of start of construction (failure results in a $500/year fine). Setbacks: at least 30 feet from any street line and 12 feet from side lines. No mobile homes, trailers, yurts, tepees, tents, or similar structures are allowed as permanent residences.
- Architectural review: Any new building or alteration requiring a Summit County building permit must be approved in writing by the Board of Trustees before starting. Applications must show location, floor plans, structural system, elevations, parking provisions, sewage design, and a construction timeline. The board can disapprove plans that are not in harmony with the surrounding landscape or that don't preserve the environment, but consent cannot be unreasonably withheld.
- Leasing & rentals: Renting or leasing a dwelling is considered a commercial use and is explicitly prohibited. Short-term, long-term, and vacation rentals are all banned.
- Fences: No fences are allowed anywhere in the subdivision.
- Signs & flags: No advertising signs — including 'For Sale' or 'For Rent' signs — are allowed on any lot. The association may not prohibit display of a U.S. flag consistent with federal law.
- Assessments & fees: Each lot owner must pay an annual common-area assessment (due before June 30 each year, with dates modifiable by the board) and an annual water use fee regardless of connection. The assessment can be based on number of lots owned, square footage, or acreage. Delinquent payments incur late fees and interest; the association can suspend gate access, utility service, or voting rights and can foreclose on the lot via a deed of trust process.
- Water & sewage: Culinary water is supplied by the association to each lot; the owner pays a connection fee and annual water use fee. Each lot must have an individual sewage disposal system approved by the Utah State Department of Health. No outside privies or outhouses are allowed.
