What Cheshire Forest Homeowners Association, Inc.'s governing documents say
Cheshire Forest is a standard single-family homeowners association (HOA) in Chesapeake, Virginia. This document is the Association's Bylaws, which sets up the governing structure — board of directors, meetings, committees, and complaint procedures — rather than listing specific homeowner rules. It binds all lot owners (members) and explains how the association is run.
- Governing structure: The Association is managed by a Board of 5–7 Directors. Directors serve staggered terms, need not be members or Virginia residents, and are elected by members at annual meetings. The Board hires officers (President, VP, Secretary, Treasurer) and may employ a manager.
- Meetings & voting: Annual meetings are held on the same day each year at 8:00 p.m. Special meetings can be called by the President, Board, or by 1/4 of non-Declarant members. A quorum is 1/10 of votes in each membership class. Members may vote in person or by proxy (proxy form included).
- Assessments & fees: The Board sets annual and special capital assessments. Special assessments require approval by 2/3 of each class. Unpaid assessments accrue 10% annual interest and become a lien on the lot; the Association may foreclose or sue. No owner can waive assessments by non-use.
- Architectural review: An Architectural Control Committee of 3 regular and 2 alternate members reviews and approves plans for exterior changes. Initial members are named; later members are appointed by the Board. The Committee may adopt guidelines. Approval is deemed given if the Board or Committee fails to act within 30 days of submission.
- Common area & amenities: Owners have an easement to use common areas (recreation facilities, etc.). The Association can charge admission fees, suspend use rights for unpaid assessments or rule violations (up to 60 days), and may dedicate or transfer common areas with 2/3 member vote. The Association maintains all common areas.
- Complaint procedures: The Board adopted a formal complaint process: members submit a written complaint form at least 5 business days before a Board meeting; the Board reviews it and issues a written decision within 7 days of the meeting. The Board does not hear appeals; members may file a final adverse decision notice with Virginia's Common Interest Community Board ($25 fee).
- What this document doesn't cover: This Bylaws document does not specify rules about pets, leasing, age restrictions, parking, renters, or lot maintenance. Those rules would be in the Declaration of Covenants, Conditions, and Restrictions (the 'Declaration'), which is a separate governing document.
