Sugarland Run is a standard homeowners association (HOA) in Sterling, VA — you own your lot and your home, and the association owns and maintains common areas (like green spaces and recreational facilities) funded by assessments on each lot. This Declaration of Covenants, Conditions and Restrictions runs with the land, meaning every owner must follow these rules, which are enforced by the HOA and an Architectural Committee.
- What you own & maintain: You own your individual lot and the house on it. You must keep your lot and all improvements in good repair — seeding, mowing, pruning, painting — in a manner consistent with good property management.
- Permitted use (single-family residences only): Lots may be used only as a single-family private residence. No commercial or business use is allowed without written approval from the Architectural Committee, and even then only if compatible with a high-quality residential neighborhood.
- Architectural review: Before any construction, alteration, or exterior color change, you must submit plans to the Architectural Committee and get written approval. The committee may also regulate signs, fences, trash containers, and tree removal (trees 6 inches or more in diameter need approval). Approval is automatic if the committee fails to act within 60 days.
- Prohibited structures & items: Only a detached house, a two-car garage, a swimming pool, patios, walkways, a TV antenna, and fences are allowed without special permission. No temporary structures can be used as residences. No lumber, trash, or bulk materials may accumulate except building materials during construction.
- Vehicles & storage: No motor vehicles other than private passenger cars, boats, boat trailers, house trailers, or similar items may be stored on a lot unless entirely hidden in a garage. No temporary buildings or trailers may be used as a residence.
- Pets & animals: Birds, animals, and insects may be kept only for domestic purposes — no commercial animal operations. The Architectural Committee may set rules on the type and number of domestic animals allowed.
- Assessments & fees: The association charges monthly assessments and may levy special assessments for capital improvements. The initial rate was $10.50 per lot for single-family owners; the board may increase assessments annually by up to 5% without a vote, and larger increases require a two-thirds vote of each membership class. Late payments can result in suspension of recreational facility access.
- Common areas & recreational facilities: Every owner has an easement to use the common areas (green areas and recreational facilities). The association may charge fees for use, suspend access for unpaid assessments or rule violations (up to 30 days), and with a two-thirds vote, dedicate or transfer common areas to a public agency.
