What Great Hawk Owners Association's governing documents say
Great Hawk is a single-family-home community in Rochester, Vermont, composed of individual building lots governed by a homeowners association. These covenants apply to all lot owners in the Great Hawk development and run with the land, meaning future buyers must also follow them.
- Architectural review & design control: An Architectural Review Board must approve any new buildings, additions, exterior modifications, site alterations, or landscaping plans before work begins. The Board can require revisions or deny proposals entirely.
- Residential & commercial use: Each lot is for one single-family home and one garage (max three-car capacity). No apartments or multifamily housing are allowed. While no commercial use or commercial activities are permitted, owners may rent or lease their property without it counting as commercial use.
- Setbacks: In the Original Sectors, buildings must be at least 25 feet from streets, side boundaries, and rear boundaries. In the Martin Sector, the front setback is 40 feet, with 25 feet required from sides and rear. These rules are subject to change by government regulations.
- Subdivision & lot boundaries: Lots may not be subdivided, and no rights-of-way, leases, or easements may be granted without Architectural Review Board approval, except as already stated in the original deeds.
- Vehicles & outbuildings: No house trailers, mobile homes, prefabricated transportable units, or vehicles designed for occupancy may be placed on any lot or common land, even if permanently affixed. Temporary buildings may not be used as dwellings.
- Signs: No signs may be erected without prior written approval from the Architectural Review Board, except a small sign displaying only the owner's name and lot number.
- Maintenance & debris: Owners must keep their premises clean, neat, and presentable. Burning of leaves, brush, or branches is allowed only if permitted by Vermont law and Rochester town regulations; burning of rubbish or building materials is not allowed.
- Tree cutting: Clear-cutting is prohibited. Trees may be cut only as needed for approved construction (house, patio, driveway) or for public safety, dead/scrub tree removal, or safety of a dwelling. Vista trimming is allowed under professional supervision to maintain the forested character.
