What Whispering Hills's governing documents say
Whispering Hills is a rural residential subdivision near Sheridan, Wyoming, with 12 large tracts (35+ acres each) governed by a homeowners' association. The rules apply to all owners of tracts, aiming to preserve a rural residential character while allowing agricultural and limited secondary commercial uses.
- Use of tracts: Each tract must be used primarily for residential and/or agricultural purposes. Commercial use is allowed only as a secondary purpose if permitted by county zoning.
- Construction standards: Only custom-built homes or high-quality modular homes are allowed. Minimum square footage: 1,100 sq ft for a single-story home, 1,000 sq ft ground floor for a two-story home. Maximum height: 36 feet at the main roof peak. No mobile homes are permitted. Construction must be completed within 24 months of starting.
- Architectural review: The homeowners' association acts as an architectural control committee. Plans, elevations, and color selections must be approved before construction begins. Buildings must harmonize with the land and neighboring structures.
- Setbacks & siting: No building or above-ground improvement may be placed within 50 feet of any exterior tract boundary (except where adjacent to state land). Buildings must be sited to minimize disturbance of views of mountains and surrounding vistas.
- Animals: Livestock, dogs, cats, and other pets are permitted but must be controlled and not become a nuisance. All animals must be kept in a dwelling or fenced area; livestock must be fenced in. After three confirmed nuisance complaints (e.g., excessive barking), a pet may be required to be removed.
- Parking & vehicles: No vehicles may be parked on any road or on a tract unless kept inside an enclosed building or screened from view of other tracts. No more than four licensed, insured, regularly-driven vehicles may be stored outside permanently.
- Assessments & fees: The association levies annual assessments to cover road maintenance and other obligations. Special assessments may also be levied. Rates are uniform per tract. Assessments not paid within 30 days bear 12% annual interest; the association may file a lien or foreclose. First annual assessment starts January 1, 2008.
