STATE OF TEXAS § § | KNOWALL MEN BY THESE PRESENTS: COUNTY OF BEXAR § That the Declaration of Covenants, Conditions and Restrictions for Arroyo Crossing Homeowners’ Association, Inc. recorded at Volume 12580, Page 125], Document Number 20060303273, Official Records of Bexar County, Texas, is hereby amended in the following particulars, to-wit: I.

Article III, Section 3.4(a) of the Declaration be amended to add the following language 10 No vehicles may be parked on the street in front of a residence except for those being used by the occupants of that residence.

Overnight street parking (i.e., between the hours of 12:00 a.m.

midnight and 5:00 a.m.) shall be restricted to one vehicle per residence.

IL.

Article {J is amended by the addition of a new subsection to Section 3.4 of the Declaration, numbered as (0), which shall read as follows: (o) No Owner shall permit any activity or condition on their property to constitute a nuisance or annoyance to other owners, including, without limitation, unreasonably loud noises, excessive dog barking, foul odors, maintenance of visual clutter of personal property being openly stored, or any other conduct or condition determined by the Board of Directors, in its sole and absolute discretion, to be a nuisance.

Article IX, Section 9.1, is amended to read as follows: Section 9.1. “Creation of Lien and Personal Obligation of Assessments” No mandatory assessments shall be duc prior to the Lot Approval Date. From and after the Lot Approval Date, Developer, for each

From and after the Lot Approval Date, Developer, for each fully developed lot in the Subdivision, hereby covenants, and each owner (other than the Developer), by acceptance of a deed to a lot, is deemed to covenant and agree to pay to an account or fund established by Developer or the Association (if the Association has been formed and is in existence Doc# 20200130326 06/18/2020 12:38PM Page 2 of 5 Lucy Adame-Clark, Bexar County Clerk as of such date) (a) annual assessments, (b) special assessments, and (c) Capital Contribution Assessments, such assessments to be established and collected as hercinafter provided. The annual, special assessments and Capital Contribution Assessments, together with interest, costs of collection and reasonable attorneys’ fees, shall be a charge on each lot and, if unpaid as described in Section 9.5 hereof, shall constitute a continuing lien upon the lot against which each such unpaid assessment is made. Each such assessment, together with interest, costs of collection and reasonable attomey’s fees, shall be the personal obligation of the owner of such lot at the time when the assessment came due. The personal obligation for delinquent assessments shall not pass to such owner’s successors in title unless expressly assumed by them, provided that the lien for such assessment shall continue and may be enforced against the lot.

IV.

A new Section, numbered as Article EX, Section 9.9, which shall read as follows, is hereby adopted: Section 9.9 Capital Contribution Assessments. In addition to the annual assessment and special assessments, there is hereby

as Article EX, Section 9.9, which shall read as follows, is hereby adopted: Section 9.9 Capital Contribution Assessments. In addition to the annual assessment and special assessments, there is hereby established a Capital Contribution Assessment, which shall be automatically imposed each time a lot is sold or conveyed, in an amount equal to the annual assessment for one lot for the calendar year in which the transfer occurs. The Capital Contribution Assessment shall be the personal obligation of the purchaser or acquiring owner as well as a lien on the Lot, as provided by Section 9.1 of the Declaration.

Vv.

Article X, Section 10.2 of the Declaration is amended by the adoption of an additional subsection, numbered as (d), which shall read as follows: (d) Owners are strictly liable to damage to, or defiling of, common area caused by themselves, and family members, tenants and guests, which shall include the expense of any fluid leaking from any vehicle and any other repairs or clean-up that are required as a result of the activity or property of the Owner, their family members.
